Toppa-AI - Terms of Service

1. Overview & Eligibility

By using the Toppa-AI mobile application ("the App") provided by SunnySora Technologies ("we", "us", or "our"), you agree to these Terms. We provide AI-powered language learning assistance using Google Gemini models and manage subscriptions via RevenueCat.

Age Requirement: You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use the App. If you are under 18, you may only use the App with the involvement and consent of a parent or legal guardian.

2. AI Content Disclaimer

The App uses Artificial Intelligence to generate content. You acknowledge that AI-generated responses may contain inaccuracies, errors, or unexpected statements. SunnySora Technologies is not liable for errors, hallucinations, or any consequences resulting from the reliance on AI-generated information.

3. Subscriptions & Billing

Premium features require a paid subscription managed through the Google Play Store or Apple App Store.

Auto-Renewal: Subscriptions renew automatically unless canceled via your respective store account settings prior to the end of the billing period.
Cancellations: You must cancel your subscription directly through your Google Play Account or Apple ID settings. Deleting the App or your Toppa-AI account does not automatically cancel your billing agreement.

4. Account Deletion & Data Removal

In accordance with Google Play's and Apple's User Data Policies, we provide a transparent path for account and data deletion.

Important: Deleting your account is permanent. All AI progress, lesson history, and profile data will be wiped. This action cannot be undone.

How to Delete Your Account:

In-App: Navigate to Settings > Delete Account. You will be prompted to confirm your choice.
Web Request: If you no longer have the App installed, you may request account deletion by emailing support@sunnysora.org. We will process your request within 7 business days.

Note: Deleting your account does not cancel your store subscription. You must manage your subscription through Google Play or Apple App Store to stop future billing.

5. Acceptable Use & AI Safety

You agree to use Toppa-AI's AI features responsibly. You are strictly prohibited from using the App to generate, share, or promote content that includes:

Hate Speech: Content that promotes violence, incites hatred, or promotes discrimination based on protected characteristics.
Harassment: Engaging in bullying, stalking, or demeaning messages.
Dangerous Activities: Instructions for self-harm, violent acts, or illegal activities.
Sexually Explicit Content: Generating pornography or sexually gratifying content.

Enforcement: We reserve the right to suspend or terminate accounts immediately and without refund for violations of these safety standards.

6. Fair Usage Policy (FUP)

While Toppa-AI offers "Unlimited" messaging and scenarios to Premium subscribers, these features are intended for individual personal use to ensure service stability for all users. Usage is monitored through an "Energy" system based on AI tokens consumed and search queries performed.

Personal Use Only: Accounts may not be shared, automated, or used for "botting." Any usage patterns suggesting non-human interaction may result in immediate suspension.
Resource Allocation & Energy Limits: Your subscription tier provides a daily energy limit. Generating content, translations, and chat messages consumes this energy. We reserve the right to throttle or limit access if your usage significantly exceeds the limits or the average of other Premium members, which could impair the service for others.
"As Is" Service: Per Section 8, the service is provided "as available." Technical limitations or throttling applied to protect infrastructure do not constitute a breach of contract.
Advertising & Service Tiers: SunnySora Technologies provides a free tier supported by advertising. Users who choose not to consent to data processing for advertising purposes, or users utilizing ad-blocking technologies, may be moved to a "Basic Tier" with lower daily energy limits and restricted features to ensure the continued sustainability of the service.

7. Intellectual Property

All rights, title, and interest in and to the App itself (including its code, design, and branding) are and will remain the exclusive property of SunnySora Technologies. Any content generated by you through the App remains your property. However, you grant SunnySora Technologies a worldwide, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods now known or later developed, for the purposes of operating, developing, providing, and improving the App.

8. Limitation of Liability, Governing Law, and Dispute Resolution

The App is provided "as is" and, to the maximum extent permitted by law, SunnySora Technologies shall not be liable for any indirect or consequential damages. These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration in Santa Clara County, California, rather than in court.

SunnySora Technologies does not endorse and is not responsible for the content of third-party advertisements. Any interactions with advertisers are at your own risk.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice (such as via an in-app notice or updating the "Last updated" date at the top of this page) before any new terms take effect. Continued use of the App following any changes constitutes acceptance of the new Terms.

Terms of Service
